US iPhone ban isn’t out of the question in Qualcomm battle

Earlier a Chinese court ordered Apple to stop sales of iPhones in its third largest market.

Qualcomm (qcomm) is requesting courts in China ban the iPhone XR, iPhone XS, and iPhone XS Max from the country, Financial Times is reporting.

China may not even care if Qualcomm has a legal leg to stand on, yet could go ahead and ban sales of iPhone regardless to hurt America's most valuable company.

For the unaware, Qualcomm recently convinced a Chinese court to issue a temporary ban on the sale of many of Apple's older smartphones in the country. Qualcomm also owns patents on key pieces of mobile technology that Apple and other manufacturers use in their products.

The judge who made the decision not to order a USA import ban on the iPhone, Administrative law judge Thomas Pender, has retired and is no longer a member of the tribunal. Apple said it filed a request Monday for the court to reconsider its ruling.

In his early years running Apple, Tim Cook would respond to questions about increasing manufacturing in the United States by saying the skill sets in China are more conducive to producing the company's products.

The smartphone maker is reportedly accusing Qualcomm of playing dirty business tricks, including asserting patents that the company had never used before as well as a patent that already had been invalidated by several global courts. With no sign of a settlement agreement on the horizon, Qualcomm remains intent on turning up the pressure on Apple. The company is also said to be working on its own ARM-based SoCs for use in Macs in 2020.

"Apple and many other companies, consumers, and government will suffer truly irreparable harm", the company said in the filing.

The court action also comes amid a backdrop of increased trade tensions between Washington and Beijing and the arrest in Canada of a top executive of Chinese tech giant Huawei at the request of USA authorities.

"This is what Qualcomm needed to get some leverage to try to get Apple to finalize a deal", said Mike Walkley at Canaccord Genuity LLC.
