Earlier this year, the Justice Department made it more hard for immigrants claiming to be victims of domestic or gang violence to get asylum.

The attorney for the US DOJ, Erez Reuveni, could not confirm where Carmen and her daughter actually were at the time.

The ACLU said later that government attorneys confirmed to them after the hearing that the pair was on a flight en route to El Salvador.

The ACLU said they were told by government attorneys after the hearing that the woman and child were already on a flight to El Salvador, but would be sent back to Texas, where they had been detained. None of the adults had been separated from their children as part of President Trump's "zero-tolerance" policy.

Sessions" unexpected announcement negated a comparatively more vague 2014 Board of Immigration Appeals ruling that married women in developing countries "who are unable to leave their relationship" can be considered a "particular social group' for asylum purposes.
