The infant is one of hundreds of children who have yet to be reunited with their parents, with many separated from their families under the Trump administration's recently rescinded "zero tolerance" family separation policy.

"It's extremely disappointing that the Trump administration looks like it will fail to reunite even half the children under 5 with their parent", said ACLU attorney Lee Gelernt.

In total, the administration said it expects to ultimately reunite 75 of the 102 children with their parents.

The ACLU sued in March on behalf of a Congolese woman who was separated from her daughter for five months after seeking asylum at a San Diego border crossing and a Brazilian asylum-seeker who was separated from her son after an arrest for illegal entry in August near the Texas-New Mexico border.

US District Judge Dolly Gee said the government had failed to present new evidence to support revising a court order that limits the detention of children who crossed the border illegally.

Federal officials said they are reunifying as many children as they can and attributed delays to "legitimate logistical impediments" that make it "impossible or excusable" to meet the court's deadlines.

Gelernt, the ACLU lawyer, said in court that the government had taken "significant steps" to reunite families but should be moving more quickly.
