Three judges rule for democracy in North Carolina's congressional districts

A three-judge panel on the U.S. District Court for the Middle District of North Carolina ruled Tuesday that the state's 2016 redistricting plan constituted an unconstitutional partisan gerrymander and said the state's districts need to be redrawn before the 2018 midterm elections.

North Carolina Republicans have asked the Supreme Court to block a federal district court's decision to strike down the state's congressional voter map.

The justices might be likely to put a hold on the lower court order because they are now considering two other cases on partisan gerrymandering, including one about Wisconsin statehouse districts that is expected to determine whether maps can be challenged at all on the basis that they entrench a benefit to one political party over another.

The motion says there's also not enough time for the judges to review a new map before candidate filing begins February 12.

The decision may also lend support to two other challenges to gerrymandering now before the Supreme Court.

"In sum, the three-judge panel has used an entirely novel legal theory to hopelessly disrupt North Carolina's upcoming congressional elections", the document states.

The evidence showed the "plan achieved the General Assembly's discriminatory partisan objective", U.S. Circuit Judge Jim Wynn wrote in the case's chief opinion. It throws a new wrinkle and more uncertainty into the 2018 election cycle in North Carolina a month before candidates were scheduled to file for office. They drew themselves a 10-3 edge, State Rep. David Lewis, a co-chair of the legislature's redistricting committee, openly admitted, because "I think electing Republicans is better than electing Democrats" and "I do not believe it's possible to draw a map with 11 Republicans and two Democrats".

The federal judges have given state lawmakers until January 29 to fix the issue and show them a new map. That year, Republicans won 48.7 percent of the vote, but 69.3 percent of the seats.

As the clock ticks down on the North Carolina court order, a majority of the judges agreed that if the legislature won't alter the map, they would hire a redistricting expert to draw replacement boundaries.
