The case against Rubashkin started after an immigration raid on a kosher meatpacking company that he owned, and his arrest in 2008 by US Immigration and Customs Enforcement agents resulted in his conviction for financial crimes.

"It does not vacate Mr. Rubashkin's conviction, and it leaves in place a term of supervised release and a substantial restitution obligation, which were also part of Mr. Rubashkin's sentence". Furthermore more than 30 present members of congress have composed letters communicating endorsement for review of Mr. Rubashkin's case. Robert Teig, a former federal prosecutor in Iowa, said that Rubashkin's sentence "was what he earned because of his conduct" and that "it's a sad state when politics are allowed to interfere with the justice system".

Court filings indicate Rubashkin tried to appeal the judgment against him as recently as this year, and a federal appeals court declined to hear the case just last week.

The 57-year-old father of 10 submitted fake invoices to a bank that made Agriprocessors' finances appear healthier than they were so that it could borrow more.
