Facebook disagreed with ProPublica's stance, noting that while it does target specific age groups in ads, it uses the practice responsibly.

In addition to employment, civil rights laws prohibit discrimination in housing, employment, lending, voting and education.

Under the "magazine advertisement" argument, age-based targeting is not discriminatory because anyone can flip through a given magazine and find a recruitment ad if they look hard enough.

"Facebook allows advertisers to choose their target audience and then finds the chosen users with the extensive data it collects about its members", says the report.

But numerous tech companies engaging in this practice claim that they had no idea their ads were limited by age parameters, or that it doesn't count as discrimination because there's nothing preventing older people from actually applying for a job - if they can find out that it's open.

Other tech companies also offer employers opportunities to discriminate by age.

The case was filed several days after the 50th anniversary of Congress passing the Age Discrimination in Employment Act, and on the same day the New York Times and ProPublica published a joint investigation raising concerns over job ads aimed at younger age groups on Facebook, Google and LinkedIn. "Upon further review we realized that some of the ads presented do not, so we've removed them", a Facebook spokesperson said. And just because some younger users see age-targeted ads in their news feed, which they're only seeing because they fall into the target demo, doesn't mean that people older than 40 aren't seeing different age-targeted ads that people in the younger demo don't see. Google, on the other hand, said it doesn't prevent marketers from displaying ads based on a user's age.

According to the Lawsuit filed in Federal court in San Francisco, Companies including T-Mobile US, Amazon.com and Cox Communications and others have limited the recruitment ads that can reach the audience based on their ages as less as 38 in few companies.

Facebook is also banking on Section 230 of the Federal Communications Decency Act which protects internet companies from liability for third-party content.

The social network also used its targeting abilities to recruit its own employees from certain age groups.

Since many jurisdictions consider it a crime to aid and abet age discrimination - which it appears Facebook is indeed doing - they may be at risk of legal action themselves. An ad featuring a millennial would be targeted at a millennial, for example, while an ad targeting someone older than 40 might include a person with salt-and-pepper hair. When he scrolled through his Facebook ads on a Wednesday in December, he saw a variety of ads reflecting his interest in social media marketing: ads for marketing software HubSpot ("15 free infographic templates!") and TripIt, which he used to book a trip to visit his mother in Florida.
