European Union warns Poland over court reforms

"These laws considerably increase the systemic threat to the rule of law in Poland", European Commission vice president Frans Timmermans said after a high-level meeting on Poland.

Brussels urged Warsaw to halt consideration of the four contentious legal acts and return to rule-of-law dialogue on Wednesday, noting that the Commission's senior executives would address the suspension of Poland's voting rights next week.

The Supreme Court bill follows a law passed last week which ends the terms of current members of the National Council of the Judiciary (KRS), one of the main judicial bodies, and gives parliament powers to choose 15 of its 25 members. "We are coming very close to activating the article", he said.

It would mean that, while the Commission has long said PiS government policies put the rule of law in the country of 38 million people under systemic threat, it would now ask member states to officially confirm this assessment. If the EU notices a "serious and persistent breach" of these values it can activate Article 7 and suspend membership rights, such as voting in the EU Council or access to the single market.

The commission is arguing - in the same way it did in 2013 with Hungary, when the country's judiciary came under political pressure - that a threat to the rule of law in any European Union country threatens other member states as well, as upholding European Union law becomes unreliable. But the Rule of Law mechanism says that if no solution is found in this framework, Article 7 TEU will always remain the last resort to resolve a crisis and ensure the member state complies with European Union values.

One statement by Timmermans appears to indicate that the Commission hopes that the Polish people, once again would make the difference.

Thousands of protesters have taken to the streets in Polish cities against the governing Law and Justice party's reforms, which would give parliament powers over the selection of judges.

On July 19, Polish lawmakers sent the bill on reorganizing the Supreme Court to a specialized commission.

Poland is already embroiled in a row with Brussels over PiS's sweeping changes to the country's Constitutional Tribunal and concerns about the rule of law.

Since winning an election in 2015, the nationalist Law and Justice (PiS) party has sought to step up government influence over courts and prosecutors as well as state media.

Speaking later, Timmermans' Polish colleague, industry commissioner Elzbieta Bienkowska, warned that if the reforms were implemented, "there will not be any understanding here in Brussels".
