MA court rules for woman fired for medical marijuana use

Massachusetts' top court on Monday ruled that a woman who had been fired for testing positive for marijuana that she had been legally prescribed under state law could sue her former employer for handicap discrimination.

Monday's ruling says employers can't enforce blanket anti-marijuana policies against workers whose doctors have prescribed marijuana to treat their illnesses.

"Massachusetts is not a state where such protections are written in the law so this is really significant".

When Barbuto was sacked, a representative from human resources contacted her and informed her of her job's termination-because the company follows federal law, not state law, when it comes to cannabis. Her legal team said she got the job in 2014 and, prior to a drug test, informed managers she would test positive for marijuana.

The company, meanwhile, is alleging through "a source close to the studio" that Whitmire was "overly hostile and unproductive". According to Whitmire, he was first informed about the recasting in October, when studio executives phoned with the news.

After she started using marijuana, Barbuto said she was able to maintain a healthy weight. Instead, anti-discrimination laws require companies to attempt to negotiate a mutually acceptable arrangement with each medical marijuana patient they employ - exploring alternative medications, or allowing use of the drug only outside of work hours, for example.

"Our conclusion that an employee's use of medical marijuana under these circumstances is not facially unreasonable as an accommodation for her handicap means that the dismissal of the counts alleging handicap discrimination must be reversed", the opinion reads.

However, she was sacked in September, when she claims the business decided, "We follow federal law, not state law".

An attorney for Advantage Sales and Marketing tells The Boston Globe they're "confident" that the company acted lawfully.

A superior court judge dismissed many of Barbuto's wrongful termination claims in 2015.

Michael Clarkson, a lawyer for the company, said it was considering its options.

"We are thrilled that the Supreme Judicial Court of Massachusetts has ruled in favor of compassion for people that use medical marijuana for a range of debilitating conditions", the Massachusetts Patient Advocacy Alliance, which sponsored the state's successful 2012 medical marijuana ballot initiative, said in a statement. The case should be litigated, the court found.
