Redskins owner says he's thrilled with ruling

The U.S. Supreme Court ruled Monday that the federal government's ban on offensive trademark registrations violates the First Amendment, handing the Washington Redskins a final victory in a decades-long battle over the team's name.

The law used by the U.S. Patent and Trademark Office to prevent the National Football League team from registering trademarks in and relating to the word "Redskins" and the logos used by the team was ruled unconstitutional by the Supreme Court.

The band took the U.S. Patent and Trademark Office to court after it refused to grant them trademarks in 2011 because it deemed their name offensive.

The disparagement clause "offends a bedrock First Amendment principle: Speech may not be banned on the ground that it expresses ideas that offend", Alito wrote. The same is true for the Redskins, but the team did not want to lose the legal protections that go along with a registered trademark.

"Holding that the registration of a trademark converts the mark into government speech would constitute a huge and risky extension of the government-speech doctrine, for other systems of government registration [such as copyright] could easily be characterized in the same way", Justice Samuel Alito wrote in the majority opinion.

The Slants argued that the disparagement provision used against their trademark was unconstitutional.
