Trump's attorney contradicts himself on investigation denial

Robert Mueller, special counsel for the inquiry into Russian interference in the 2016 presidential election, has not yet made a decision to investigate President Donald Trump for obstruction of justice, ABC's senior justice correspondent Pierre Thomas reports.

U.S. President Donald Trump began his day with a stream of tweets defending his record and lashing out at the investigation into Russian interference in the election.

He was apparently referring to Deputy Attorney General Rod Rosenstein, who wrote a memo to denounce Comey and subsequently appointed Mueller (pictured below) to continue the probe.

Jay Sekulow, a lawyer who is part of a team hired by Trump to deal with allegations of collusion by his campaign with Moscow, appeared to contradict Trump's statement on Twitter on Friday that he was being investigated for firing his Federal Bureau of Investigation director last month. Trump advisers describe the president as increasingly angry over the investigation, yelling at television sets carrying coverage and insisting he is the target of a conspiracy.

Sekulow was tasked with explaining that Trump is not being investigated while somehow not contradicting his boss.

"Failure to follow these protocols could result in criminal or civil penalties, and could form the basis of legal claims, legal presumptions, or jury instructions relating to spoliation of evidence", the memo warns former Trump transition team members. "It's that simple. The president is not under investigation".

"The tweet from the president was in response to the five anonymous sources purportedly leaking info to the Washington Post", he said. "But you're his attorney, and you're saying that the president, when he said that, was not accurate".

"I don't believe it's going to happen", said Rubio on CNN's "State of the Union". Rep. Adam Schiff, the top Democrat on the House intelligence committee, said on ABC's "This Week" that the panel is looking forward to getting a response from the White House on whether recordings exist.

The president suggested on Twitter that he may have taped those conversations. Sekulow accused Wallace of rephrashing him, and Chris Wallace said that the tape will speak for itself.

Former FBI Director James Comey told the Senate intelligence committee that Trump pressured him on the Russian Federation investigation and asked him to drop an investigation into former national security adviser Michael Flynn.

Wallace came back with, "You just said, sir that he is being investigated". The Washington Post first reported the story.
