Steele says he will retry the 79-year-old comedian on three counts of aggravated indecent assault.

Cosby maintained in his original 2005 deposition that he gave Constand the antihistamine Benadryl to relieve stress and had consensual relations, accusing her of lying. Then, prosecutors would get four months to decide whether they want to retry Cosby or drop the charges.

He said Cosby was prosecuted because of worldwide headlines about the accusations against him, and because graphic excerpts from his deposition in Constand's civil suit became public. In Cosby's case, that could have involved the more than 60 other women who have accused him of assaults dating to the 1960s. "They (asked) themselves if the evidence showed beyond a reasonable doubt that Ms. Constand was coerced into taking drugs or if she willingly took drugs with an informed understanding of their effect and a willingness to engage in sexual conduct with Mr. Cosby". Jurors focused on Cosby's statements about obtaining quaaludes, a sedative and once-popular party drug that Cosby said he gave to women with whom he wanted to have sex.

"Cases such as this one are hard to prosecute when there is a delay in reporting and no (forensic) evidence", says NY criminal defense attorney Stuart Slotnick who's been following the case for more than two years. Judge Steven O'Neill reads what's known as a "dynamite" charge to remind them of their duty to try to find consensus, and he tells them to keep trying.

Bill Cosby is back in court for the sixth day of jury deliberations in his sexual assault trial.

Jurors have already discussed the case for more than 50 hours since Monday, leading to Cosby's lawyer to push for a mistrial. Because of this, Stephen O'Neill, the Montgomery County judge presiding over the #Case, ordered the jurors to further deliberate on Saturday, June 17th.
