Texas' New 'Transgender Bathroom Bill' Keeps Biological Sexes Separate in School Facilities

The House voted 91-50 to amend Senate Bill 2078 - which covers emergency plans for schools - to include language that says transgender students must use the bathroom that matches their "biological sex", according to the Texas Tribune.

The bill will now head back to the Senate and then on to governor Greg Abbott's desk, where it nearly assuredly be signed into law by Friday. The NCAA pulled several events out of North Carolina after its version of the transgender bathroom bill passed previous year.

By a final vote of 21-10, state senators agreed with their counterparts in the Texas House of Representatives that society should continue to make room for adoption and foster care services associated with a religious tradition, whether Christian or Muslim.

Texas legislators on Sunday night passed a so-called "bathroom bill" and a piece of legislation that will allow religious discrimination against would-be adopters in what LGBT advocates have dubbed "Discrimination Sunday". Republican Representative Chris Paddie from East Texas authored the House amendment.

Texas' Republican-controlled Legislature originally sought to force transgender people to use most public restrooms corresponding to the gender on their birth certificates. That could shock classmates who don't know the youngsters are transgender. "Some people don't want to admit that because they are ashamed, and this is shameful". More recently, the NCAA took a brief stand against the North Carolina GOP's House Bill 2, pulling its postseason events from the state; it ultimately chose to return to North Carolina when the state's Democrats (and, in their minds, Republicans) bent and replaced the law with a slightly less heinous repeal bill.

North Carolina faced an onslaught of boycotts after it approved its bathroom bill past year.

Texas also won't face Federal consequences. Lt. Gov. Dan Patrick (R), who sponsored the Senate version, had been at loggerheads with state House Speaker Joe Straus (R), who said the measure was unnecessary.

The amendment is a slimmed-down version of Texas' Senate Bill 6, which would've applied to schools and government facilities.

"It is unconscionable that a bill would prioritize discrimination over the best interest of kids in the child welfare system, but Texas lawmakers have done just that", said Marty Rouse, national field director for the Human Rights Campaign and a foster and adoptive parent. Texas was unable to implement the 2011 voter ID law due to pre-clearance until 2013, when the Supreme Court gutted the VRA formula that put Texas and other states with a history of racially discriminatory voting practices under the pre-clearance regime.
