The older brother of Aaron Hernandez sent out birthday wishes to their mother Thursday, as the family continued to grieve the death of the convicted killer and former New England Patriot one day before.

About two hours after Baez spoke to the media, the Worcester County District Attorney released a statement officially ruling Hernandez's death a suicide and announcing they would release the former National Football League star's brain to BU's CTE Center.

"There were no signs of a struggle, and investigators determined that Mr. Hernandez was alone at the time of the hanging", the statement said.

Three handwritten notes were found in the cell but the contents weren't immediately released and authorities said there was no indication of foul play.

Baez said the family decided on giving the brain to Boston University to see if there are signs of chronic traumatic encephalopathy (CTE) in Hernandez's brain.

Hernandez's body was released to the Faggas Funeral Home in Watertown following the autopsy.

"It is literally a destruction of evidence issue", said Jose Baez on Thursday.

Sources tell 7News that a correctional officer at the Souza-Baranowski Correctional Center in Lancaster, Massachusetts, has been disciplined for missing a 2 a.m. walkthrough on Wednesday, just one hour before Hernandez was found hanging from a bed sheet in his cell.

CTE is a degenerative brain disease believed to be caused by repeated blows to the head.

An autopsy was performed by the medical examiner's office in Boston to determine his cause and manner of death, according to the Worcester District Attorney's Office.

Baez was livid, and threatened legal action against the ME's office, saying his legal team would go so far as to name specific individuals if they needed to file a protective order to receive an emergency injunction.

Fallon said he was not aware of any suicide note and officials had no reason to believe Hernandez was suicidal.

His death also came just hours before his former Patriots teammates visited the White House to celebrate their recent Super Bowl victory. That means Hernandez will likely have his conviction for the murder of Odin Lloyd - in addition to the gun charge associated with it - overturned.

Earlier Thursday, Hernandez's lawyer complained that state officials had turned over the 27-year-old's body but not his brain.

On Wednesday, Cheryl Fiandaca of WBZ Boston reported that Hernandez had written "John 3:16" on his forehead before killing himself.
